1. Acceptance of Terms

Welcome to EhAutos. By accessing or using our website at ehautos.ca (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

We may update these Terms from time to time. Your continued use of the Site after any changes constitutes acceptance of the new Terms.

2. Description of Service

EhAutos is an online marketplace that connects private vehicle sellers with potential buyers in Canada. We provide a platform for users to list vehicles for sale and for buyers to browse and contact sellers directly.

EhAutos is not a party to any transaction between buyers and sellers. We do not own, sell, resell, inspect, or handle any vehicles listed on the Site. All transactions are conducted directly between buyers and sellers.

3. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Site. By using the Site, you represent and warrant that you meet these requirements.

4. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information and to update such information as necessary.

5. Listing Vehicles

When listing a vehicle on EhAutos, you agree to:

  • Provide accurate and truthful information about the vehicle, including make, model, year, mileage, condition, and any known defects or issues.
  • Only list vehicles that you legally own or are authorized to sell.
  • Include only photos and videos that accurately represent the vehicle.
  • Set a fair and honest price.
  • Respond to inquiries in a timely manner.
  • Comply with all applicable federal, provincial, and local laws regarding vehicle sales.

6. Prohibited Content and Conduct

You agree not to:

  • List stolen vehicles or vehicles with undisclosed liens.
  • Misrepresent the condition, history, or features of a vehicle.
  • Post false, misleading, or fraudulent information.
  • Use the Site for any illegal purpose.
  • Harass, threaten, or abuse other users.
  • Attempt to manipulate or circumvent the Site's systems.
  • Post spam, advertisements, or promotional content unrelated to vehicle sales.
  • Infringe on the intellectual property rights of others.
  • Use automated systems to access the Site without permission.

7. Fees and Payments

Listing fees are displayed at the time of posting and vary based on the listing tier selected (Standard, Premium, or Pro) and the vehicle price. All fees are in Canadian dollars (CAD) and are non-refundable unless otherwise stated.

EhAutos does not charge any commission on vehicle sales. The listing fee is a flat fee for the advertising service.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

EhAutos does not warrant that:

  • The Site will be uninterrupted, secure, or error-free.
  • Any information provided by sellers is accurate or complete.
  • Any vehicle listed is in the condition described or free from defects.
  • Any transaction between buyers and sellers will be completed satisfactorily.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EHAUTOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY TRANSACTION BETWEEN USERS.

EhAutos is not responsible for:

  • The condition, legality, safety, or quality of any vehicle listed.
  • The accuracy of any listing information provided by sellers.
  • The conduct of any buyer or seller.
  • Any disputes arising from transactions between users.
  • Any loss, damage, or injury resulting from vehicle purchases.

Our total liability to you for any claims arising from your use of the Site shall not exceed the amount you paid to us in listing fees in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless EhAutos and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Site, your listings, your violation of these Terms, or your violation of any rights of another party.

11. Intellectual Property

The Site and its original content, features, and functionality are owned by EhAutos and are protected by copyright, trademark, and other intellectual property laws.

By posting content on the Site (including photos and descriptions), you grant EhAutos a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content for the purpose of operating the Site.

12. Termination

We reserve the right to suspend or terminate your account and access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate.

Upon termination, your right to use the Site will immediately cease. Any fees paid are non-refundable.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.

14. Dispute Resolution

In the event of any dispute between users (buyers and sellers), EhAutos encourages parties to resolve disputes amicably. EhAutos is not obligated to mediate or resolve disputes between users but may, at its discretion, provide assistance.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EhAutos regarding your use of the Site.
